Family Limited Partnerships: Discounts, Options, and Disappearing Value

Family partnerships have been become increasingly popular as a means of avoiding estate and gift taxes. As other freezing techniques closed off by statutory anti-abuse rules, planners resorted to vehicle for transferring assets within family at deeply discounted values. Discounts ranging from one third over half the value underlying are routinely claimed, often allowed, based on lack marketability control, even where these disabilities no lasting or ascertainable economic effect. Nevertheless, use suppress transfer tax purposes rests shaky conceptual premises that deserve closer scrutiny.
